Richard G. Harvey, Jr., a citizen and taxpayer of this state, petitioned this court for leave to commence an original action in the supreme court. The respondents are James R. Morgan, commissioner of taxation, and Dena A. Smith, treasurer of the state of Wisconsin. The attorney general, representing the respondents, advised this court by letter that he did not oppose the petitioners motion. The court granted leave for petitioner to commence an original action. The respondents demurred to the complaint on the ground that it did not state facts sufficient to constitute a cause of action.
